CAR ACCIDENT BENEFITS ARE BENEFITS WHICH ARE PAID OUT UNDER ONTARIO’S “NO-FAULT” SYSTEM AND ARE CALLED “ACCIDENT BENEFITS.”

Car Accident Benefits COVER A WIDE VARIETY OF CATEGORIES These categories include such things as:

INCOME REPLACEMENT BENEFITS:

Should you become disabled as result of an automobile or from a car accident, you may be eligible for weekly income replacement benefits of up to $400, unless you have purchased higher benefits. The payments will begin within 10 Business days after your completed application and disability certificate is received by your insurance company.

CAREGIVER BENEFITS:

If at the time of the accident you lived with a person who required care, you may be entitled to a caregiver benefit of up to $250 per week for one dependant, plus $50 per week for each additional dependant.

NON-EARNER BENEFITS:

If you do not qualify for Income Replacement benefits or Caregiver benefits, your standard Car Accident Benefits coverage could help you, if you are eligible, to receive a weekly payment of $185. Non-earner benefits are payable 26 weeks after your car accident. This is only available if you are completely unable to carry on with your normal, everyday activities. If you were in school at the time of the accident, you may be entitled to $320 per week for 104 weeks from the date of the accident.

MEDICAL AND REHABILITATION BENEFITS:

The standard maximum amount for medical and rehabilitation expenses, such as physiotherapy, chiropractic treatment, dental expenses, etc., is $50,000. If you are catastrophically injured, the maximum is $1,000,000. If your injury falls under the Minor Injury Guidelines, you are limited to $3,500 for medical and rehabilitation benefits.

HOUSEKEEPING BENEFITS:

Under standard policies these benefits are only available to car accident victims who have suffered a catastrophic impairment. In that case, the auto insurer may be obligated to pay up to $100.00 per week for incurred housekeeping expenses.

Attendant Care Benefits:

Attendant Care Benefits is compensation in cases where an accident victim can show reasonable cause for requiring attendant care services. The benefits are intended to assist a victim in improving his or her health after sustaining injury.

An injured person who did not sustain catastrophic impairment can receive up to $3,000 per month for attendant care; someone who has sustained a catastrophic impairment can receive up to $6,000 per month for attendant care.

OTHER BENEFITS:

– The expenses of family members who visit during treatment or recovery may include travel and accommodation expenses, mileage and meals.
– Loss of educational expenses for students, to a maximum of $15,000.

HOW MUCH COMPENSASTION CAN I RECEIVE FOR PERSONAL INJURY CLAIMS?

The final phase of your claim is the Personal Injury Compensation settlement. Usually clients want to know up front how much money the average personal injury settlement brings. There is no minimum or maximum settlement amount. The amount of a settlement in a personal injury case depends on many factors including: the nature and extent of the injury, the amount of economic damages (such as lost wages and medical bills) and the prognosis for how long the injury should last. The longer your recovery period, the greater your pain and suffering, therefore the higher the settlement value your bodily injury claim will be.

RECEIVING THESE CAR ACCIDENT BENEFITS AND COMPENSATION DOES NOT AFFECT YOUR AUTO INSURANCE RATES. YOUR ANNUAL PREMIUM IS BASED ONLY ON YOUR DRIVING RECORD, TYPE OF CAR, AND THE NUMBER OF “AT-FAULT” ACCIDENTS YOU MAY HAVE HAD IN THE PAST.

TIP OF THE DAY

Do you know that …

…due to changes coming into effect September 1st 2010, Ontario drivers will lose half of their accident health benefits unless upgrades are bought. If you do nothing and buy the “basic package” you will have your benefits reduced drastically from what they were before. You will however be given the choice to restore your benefits to previous levels or increase them.
